Your submission of this Wholesale Application indicates that you agree to the terms of the following Wholesale Agreement:

1. Minimum Order Value:

• To qualify for wholesale pricing, the minimum order is at least 1 case of 12.

 

2. Registration for Wholesale Pricing:

• You must be a registered wholesale user to view wholesale prices on our website.

• A current retail sales tax license is required for registration (PDF or image upload). Non-profits must submit their 501(c)(3) Verification Letter.

 

3. Order Placement:

• All orders must be placed via our website, email, or fax.

4. MSRP, Published Prices, and Online Sales:

• Products purchased from Mister Ben’s Amazing Products may be sold in physical stores at any price above wholesale.

• Reselling on online marketplaces (e.g., eBay, Amazon) requires express written permission from Mister Ben’s Amazing Products.

• Products sold online must adhere to the Manufacturer’s Suggested Retail Price (MSRP) or current retail prices on www.misterbens.com, whichever is lower.

• Failure to comply may result in the immediate termination of your account and potential legal action.

5. Reselling to Other Wholesale Accounts:

• Wholesale Accounts may not distribute Mister Ben’s products to other resellers without ensuring they adhere to the same terms outlined in this agreement. Non-compliance may result in termination and legal action.

6. Product Images:

• We provide product images for your use. Any imagery you create must be approved by us before use (allow two weeks for approval).

 

7. Wholesale Pricing:

• After approval, you will have access to wholesale products and pricing online. Prices are subject to change without notice.

 

8. Returns:

• Return requests must be made within 7 days of receipt. Returns will not be accepted without prior approval. A 15% restocking fee plus shipping may apply.

 

9. Payment Terms:

• All orders require pre-payment. Payments can be made via credit card on our website or through a link provided in your invoice. Checks are not accepted.

• While we do not offer credit terms at this time, special circumstances may be considered. Such exceptions will require a credit check and approval.

 

10. Packaging and Displays:

• Products are shipped unpackaged by default. Retail packaging is available upon request. For custom packaging, contact our wholesale team.

 

11. Shipping:

• Shipping costs are not included for orders under $1,000. All shipments are made via UPS, FEDEX, or USPS. Special shipping terms can be arranged upon request.

 

12. Damages and Defects:

• Inspect all shipments immediately upon arrival. Report any damages within 5 days to wholesale@misterbens.com. We will replace damaged or defective products within 15 days of receipt.

 

13. Delivery Timeline:

• Orders typically ship within 7-14 business days. Contact us for specific lead times.

 

14. Backorders:

• Backordered items will be listed on your invoice and shipped with future orders. Orders over $300 will not incur shipping charges for backordered items.

15. International Orders:

• We do not currently ship wholesale orders internationally due to customs and shipping complications.

 

16. Warranty of Merchantability and Misrepresentation:

• Mister Ben’s Amazing Products makes no warranty, express or implied, regarding the merchantability of goods. You agree to indemnify us for any legal actions arising from misuse or misrepresentation of the products by your customers or end-users.

 

Mister Ben’s Amazing Products reserves the right to change the terms of this Agreement as necessary.  Prices are subject to change without notice. Either party with 30-day written notice can terminate wholesale relationship.
